If, on account of the objection, Smiling House is no longer able to perform the services contractually agreed with you, the objection shall be deemed to be a breach of contract by you and Smiling House shall have the right to terminate its contract with you without notice. Payment obligations already contractually entered into by you remain in force.

Purpose of Data Processing

Smiling House processes the personal information of its customers for the purpose of facilitating bookings, including:

  • booking;
  • cancellation;
  • management of check-in and check-out;
  • communication with the customer regarding their booking and all requests;
  • operation of the booking;
  • improvement of offers from Smiling House and its positioning in the market; and
  • securing payment transactions.

 

Booking Process

If you start a booking process, we collect booking data and personal information, in particular your name, physical address, date of birth, telephone number, e-mail, and passport number.

 

Sharing Of Data with Authorities

For legal and regulatory reasons, it may be necessary that we share certain personal and booking information with local government authorities the EU.

Smiling House is also obliged to share your personal information with criminal prosecution, administrative, or judicial authorities in Switzerland and abroad in case they require its disclosure for the prevention or prosecution of crimes, misdemeanors, or comparable administrative misconduct. “Unruly clients” are clients who display improper, aggressive, or violent behavior towards other guests and/or staff, or who damage the property in which they are staying.

Smiling House is entitled to exchange its clients’ personal information within the Smiling House group and with other agents and operators in order to document, analyze, and prevent cases of fraud and instances of “unruly clients”, and to process the data relating thereto.

If you have harmed or injured staff or other clients, Smiling House can also disclose your personal information in connection with the harm and injury caused to other third parties (e.g. the authorities, injured persons, and insurance companies).

 

Marketing Activities and Personalized Advertising

Smiling House may provide you with information about our products and services which are similar to or the same as others you have purchased or used previously (direct marketing) which we believe may be of interest to you. You have the right to ask us not to process your Personal Information for direct marketing purposes. Offers from Third Parties in the Scope of Bookings

In the scope of bookings, Smiling House will show you offers from third parties (e.g. from transfer, ski instruction, massage, restaurants and other in-resort suppliers) on its Site; these offers are created on an anonymous basis.
